However, Balaji Telefilms has been directed to show a disclaimer before the film starts stating that the film has no resemblance to the alleged former smuggler Haji Mastan.
On Tuesday, a city civil court declined to stay the release of the film Once Upon a Time in Mumbaai starring Ajay Devgan, Emraan Hashmi, Kangana Ranaut, and Prachi Desai.
Recently, the adopted son of Haji Mastan filed a suit seeking a ban on the release of the film saying that it tries to defame his late father by portraying him as a goon.
Dinesh Gandhi, lawyer of Ekta Kapoor, argued saying that Kapoor has never made any such comments on any newspaper. He said, "They are free to publish whatever they wish to but did they quote us?"
Gandhi also added that they had refused all such allegations in a letter and it was just a fictional story. He argued, "Why do you connect Haji Mastan to an underworld film when you have already claimed that he was not an underworld person".
According to Gandhi, Mirza should rather ask the censor board to register his objection.
Mirza wished to watch the movie before its release. He said, "We will approach to the High Court if we are not satisfied". He is also ready to approach censor board very soon.
The film is slated to release on July 30.
