A health charity in India is suing the country's government over the ban on gay sex in the country.
The Naz Foundation, which works to prevent HIV and Aids has filed the suit in the Delhi High Court.
It claims that banning gay sex is "a blatant abuse of human rights".
The Indo Asian News Service says Judges Devinder Gupta and S K Kaul have asked the federal government, the ministry of social welfare, Delhi's commissioner of police, the Delhi government and the National Aids Council to file replies to the suit by January 28, when the case will next be heard.
"The fear of harassment by police minimises the opportunity to negotiate safer sex options by forcing interactions to be furtive and quick," Naz Foundation spokesman Shaleen Rakesh says.
