According to his lawyer Satish Mansingde, senior counsel V.R. Manohar would argue the case.
Mansingde asked the court to take into consideration the provisions of the Probation of the Offenders Act on grounds of good conduct and behaviour.
The act empowers a court to release certain offenders on probation for a certain period of time before the quantum of sentence has been passed.
He also said there had been no adverse reports against Dutt in the past 13 years since he had been on trial - either from the jail or outside in society.
Special public prosecutor Ujjwal Nikam opposed the extension of bail but agreed to the interim relief.
