Justice B.V. Pinto granted conditional bail to Darshan and posted the case for Oct 13 when he wants the actor and his wife Vijayalakshmi to appear in court.
Darshan was asked to submit a personal bond of Rs.25,000. His release will end his 29 days of judicial custody.
Vijayalakshmi told after the verdict: "I am extremely happy about this development. I will assure all the fans and friends of Darshan that such things will not occur in future."
"I will seek their pardon. It was a bad time and both of us never realised that things will go to such extremities. I am too eager to invite my husband to our residence," she added.
Darshan's brother Dinakar Thoogudeepa, who directed the actor's recently released film "Sarathi" which has become a massive hit, said the news has gladdened the lakhs of fans around the state who supported them in a big way.
He said he was sure that Darshan and his wife would have their best years in the future.
Speaking from his jail cell with some reporters and his brother, Darshan said he was waiting for the golden moment.
Writing a letter to his fans, he said he wanted to get bail mainly because he wanted to seek pardon of his fans who were upset with these developments.
"My fans have ensured that their love and affection towards me remains steadfast even during the times of big crisis I faced in life.
I will seek pardon for whatever has happened and will ensure that I will be a better "Sarathi" (guide) in my family life," the letter said.
Kannada Film Producers Association president Munirathna wished the couple good days ahead. He said Darshan and his wife should forget whatever happened earlier and start their life afresh.
Darshan was arrested Sep 9 after Vijayalakshmi gave a five-page complaint to police detailing the beatings she had suffered.
But within hours, she changed her statement to say she was injured from a fall in the bathroom and not due to any beating by Darshan.
The actor will be released in the evening as cancellation of the warrant of judicial custody has to be passed by the metropolitan magistrate.
