Iranian music band Barobax Corp had filed a suit in the High Court alleging infringement of their copyright over the prelude used in the catchy 'Pungi Baja de' track from the film being co-produced by Khan.
The petitioner claimed the initial portion of the track was "lifted without any change" from the title song - 'Soosan Khanoom' of their album, released in January 2010 and registered in Canada in 2011.
The band had sought injunction on the film's release on March 23 and restraining the producers from using the disputed song in the movie. Justice S J Vazifdar, however, refused to grant an interim stay observing that the copyright was in the name of three authors - Kashayar Haghgoo, Kevian Haghgoo and Hamid Farouzmand.
"Prima facie the registration certificate shows the three persons as authors and not Barobax Corp. The suit has not been filed by those three persons. There is nothing on record to show that they have assigned copyright to the company, " the court said.
