Dutta claims that Gladrags is using her pictures without permission for their upcoming super model contest thereby violating her copyright.
Gladrags contended that they had purchased Dutta's photograph from a photographer who claimed that he had the license to use her photographs in any manner he wanted to.
Janak Dwarkadas, counsel for Gladrags said that they used the photographs only after the photographer gave in writing that he can use the pictures for publication.
However, the photographer has not been made a party to the suit, Dwarkadas said. "It is also learnt that there is some agreement between Dutta and the photographer. The said agreement was also not produced before the court," he said.
Justice D.G. Karnik yesterday adjourned the matter to April 5 and directed Gladrags to not use Dutta's pictures for promotion till then.
