Bank of India had granted loan to Harmonics Fabrics Fashions Ltd which had defaulted in repayment of instalments.
Yukta's landlord, Sanjivani, had stood as a guarantor for the company and hence the bank approached DRT to attach his property.
Yukta approached the DRT with a plea that she was a tenant and could not be removed from the flat. As DRT did not consider her plea, she moved the High Court urging for relief.
The High Court had asked the bank not to displace Yukta from her flat and maintain status quo till October 28 last year. The court had also given Yukta liberty to move the DRT, but instead she was recently asked to vacate the flat. Being aggrieved, she moved the High Court.
Yukta has been residing at Excellency Cooperative Housing Society at Lokhandwala in suburban Andheri on a leave and license basis. She had paid Rs 7.5 lakh to her landlord as security deposit.
In 2004, the Bank of India informed Yukta that it had initiated proceedings in the DRT against the company and its guarantor Sanjivani to recover its loan under Section 13 (2) of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act.
The actress filed an affidavit saying she had received anonymous threatening calls on telephone allegedly on behalf of the bank asking her to vacate the flat.
