Justice S C Dharmadhikari today asked defence counsel Ajit Marwari to address the court tomorrow on the maintainability of his client's plea in the High Court.
Salman had moved the anticipatory bail plea after a Jodhpur court had cancelled his bail and issued a non-bailable warrant (NBW) when the actor did not appear in court on the day of recording of his statement and final arguments in the case.
On December 12, Jodhpur Chief Judicial Magistrate Brijendra Kumar Jain had rejected the actor's plea seeking permission to exempt him from being present during the recording of his statement and final arguments.
In his plea, Salman had contended that he should be exempted from being present in court as he was undergoing hair-weaving surgery and, and as per medical advice he was not allowed to leave his residence for two days.
He had also prayed the court to set aside the NBW and restrain the Rajasthan Police from arresting him.
The actor had also appealed that in the event of his arrest, he should be allowed to be released on bail.
Salman had been booked by the Jodhpur police under the Wildlife Protection Act for allegedly killing a deer and two blackbucks at Ghoda Farms and Bhawad, respectively, in Jodhpur in October, 1998.
