While responding to the queries of public prosecutor, JW Marriot's parking assistant Kalpesh Verma stated that he was on duty from 7 pm to 7 am on September 28-29, 2002 and saw Salman seating on the driving seat of the vehicle before it left the hotel.
While narrating the happenings of the fateful night, Kalpesh further confirmed that Salman was accompanied by Kamal Khan who was seating on the back seat of the car, whereas actor's bodyguard kept standing outside till the star drove his car away.
Kalpesh further informed the court that, before leaving the premises actor asked him the number of parking attendants present, to which Kalpesh replied: "Four or five." The actor then took a 500 rupee note from Kamal and gave it to Kalpesh as tip. After which Kalpesh left to put the money in a box and by the time he returned, Salman had already left.
Twisty Turny headway
Ever-since the day this hit and run case has come to limelight, it has witnessed numerous twists and turns. Earlier it was the statement of JW Marriott's bar tender who confirmed Salman's presence in the hotel bar on night of September 27-28, 2002, but exhibited his ignorance about Salman's taking a drink Even this statement of the bar tender uptill some extent flummoxed the court and prosecution.
In another such instance in August this year Mumbai Police told the court that the case diary pertaining to the case has gone missing in addition to 55 of the 63 case related documents which were already missing. As a response to this plea of of Mumbai Police, court asked prosecution to file a report on further course action and even directed former investigating officer of the case, Kisan Shengal to be present at the next hearing scheduled on September 12.
Case History
In the past Salman had been tried by a magistrate for a lesser offence of causing death by negligence, which entailed an imprisonment of two years. But while considering the demand of the prosecution court re-framed the charges of culpable homicide not amounting to murder against the actor which, attracts a 10-year sentence.
